UK Falun Gong practitioners also recently entrusted an attorney to file a lawsuit against Bo Xilai for crimes of Torture against fellow Falun Gong practitioners in China. The Metropolitan Police at New Scotland Yard accepted the formal allegation made against Bo Xilai for serious crimes and a request for his arrest upon arrival in the UK by issuing a Crime Number.

A civil class action lawsuit against Bo Xilai (Minister of Commerce and formerly Governor of Liaoning Province of the People’s Republic of China) was filed at the United States District Court for the District of Columbia by Attorney Morton Sklar and Attorney Lana Han, Case No. 1.04CV00649 (LI Weixum v. Bo Xilai).  The complaint, brought by Li Weixun and others, alleges such serious human rights abuses as torture, genocide and other crimes against humanity carried out by Defendant Bo while persecuting Falun Gong practitioners in China.

Renowned Chinese Australian artist and Falun Gong practitioner Ms. Zhang Cuiying filed a Petition to the United Nations Commission on Human Rights via human rights attorney Mr. Christ Nyst. The Petition is against Jiang Zemin who initiated the persecution of Falun Gong in China. Mr. Christopher Nyst is the lawyer acting on Ms. Zhang's behalf. This is the first case of a suit being filed by an individual to United Nations on the persecution of Falun Gong practitioners in China.

Legal action was filed with a court in France against Chinese Culture Minister Sun Jiazheng for crimes of torture in his involvement in the persecution of Falun Gong practitioners in China. Mr. Sun was accompanying President Hu Jintao on a state visit to France when the case was filed.

Two criminal complaints were filed with the Office of Prosecutor in Seoul, Korea, against former President of China Jiang Zemin and Luo Gan, head of Communist Party Falun Gong Control Office for violation of Genocide Convention.

Germany

The German lawyer Mr. Wolfgang Kaleck, who first gained notoriety for successfully representing German victims of former Argentine President Jorge Videla who was charged with the torture and killing of thousands during his rule in the late 1970s and early 1980s, filed a lawsuit on behalf of Falun Gong practitioners with the German Supreme Court against Jiang Zemin and other Chinese leaders on charges of genocide and crimes against humanity and torture, as well as dangerous bodily harm to Falun Gong practitioners in China. A criminal lawsuit was filed with the Federal Prosecutor in Karlsruhe, Germany.

Mr. Georges-Henri Beauthier, best known for his role in bringing charges against former Chilean dictator Augusto Pinochet as well as bringing the first successful case under Belgium’s human rights laws against two individuals for their roles in the Rwandan genocide of 1994, filed a criminal lawsuit in Belgium against former President of China Jiang Zemin, and two of his senior aides: Li Lanqing and Luo Gan. The lawsuit charges the three men with genocide, torture and crimes against humanity.

On February 8, 2001, individual plaintiffs on behalf of themselves and others in the designated class of injured parties similarly situated, filed a class action lawsuit in the United States District Court of the Northern District of California, against Xia Deren, Deputy Provincial Governor of Liao Ning Province, China for torture and genocide.

A U.S. Magistrate Judge denied foreign sovereign immunity to Beijing Party Secretary and former Beijing Mayor Liu Qi, and Vice Governor of Liaoning Province, Xia Deren. In a report submitted to the Court, the Magistrate Judge recommended a guilty finding for both Defendants. On June 11, 2003, a U.S. Magistrate Judge, Edward M. Chen denied foreign sovereign immunity to former Beijing Mayor Liu Qi (see Liu Qi), and Defendant, Xia Deren. In a report submitted to the court, the Magistrate Judge recommended a guilty finding for both Defendants.

A criminal lawsuit was filed in France charging the former Vice-Premier of China, Mr. Lanqing Li – who was the acting administrative head for the “6-10 Office” – with crimes of torture. In July 2003, the French criminal court began legal proceedings on the case.

USA

Falun Gong practitioners and their families filed a lawsuit in the Northern District Court of Illinois against Jiang Zemin and China’s “610 Office,” the institution specifically set up for carrying out the campaign of terror to eradicate Falun Gong, for torture, genocide and other crimes against humanity. On June 11, the court accepted a brief of Amicus Curiae signed by 38 members of the U.S. Congress in support of the plaintiffs.  On September 12, 2003 the court dismissed the claims against defendant Jiang based on the (mistaken) view that former heads of state enjoy immunity for torture and genocide in U.S. courts. Plaintiffs have begun the process of their appeal to the US 7th Circuit Court.

During the United Nations 59th Human Rights meeting, Mr. Philip Grant, President of TRIAL (Track Impunity Always), announced plans to launch a lawsuit against Jiang Zemin for torture, crimes against humanity and genocide if the former Chinese leader ever visits Switzerland.

USA

The U.S. District Court of the Southern District of New York ruled against Zhao Zhifei, chief of police and second-in command of the “6-10 Office” in Hubei Province. In this case, the judge issued a default judgment against Zhao Zhifei and awarded nominal damages to the plaintiffs by request of plaintiffs’ counsel. On December 21, 2001, Judge J. Cote of the United States District Court of the Southern District of New York ordered, adjudged and decreed that the plaintiff have judgment against the Defendant.
